Definitions

Goods - Any product advertised for sale on our website and / or in any direct electronic communication such as email marketing.

Buyer - The customer who purchases or agrees to purchase any item via this website.

Special Order Items - Goods that are ordered and / or manufactured specifically for the Buyer.

Carrier - The Company who collects, transports & delivers the Goods on behalf of JCP Trading Ltd or it's Supplier.

Supplier - The manufacturer, Importer or Distributor of Goods advertised.

Risk & Ownership

Ownership of the goods will be transferred to the Buyer when the Company receives full payment in cleared funds regardless of whether the Goods have been delivered. The Goods shall be at the Buyers' Risk once delivery has taken place.

Limitations of Liability

The total liability in regard to the performance of this contract shall not exceed the value of the Goods purchased. The Company shall not be liable for any direct, indirect or consequential losses, costs or expenses incurred or any consequential compensation arising out of the performance/or non performance of this contract. The Company reserves the right to refuse any order that is subject to an error on its web site and will in these circumstances reimburse the Buyer in full. The Company reserves the right to investigate any order placed on this website that it suspects to be fraudulent, any such order will not be delivered until it is proven that that the order is bona fide. Should the Company be unable to prove that an order is bona fide or to contact the Buyer then the monies will be refunded to the original card used to place the order and the order will be cancelled.

Description of Goods

Whilst the Company makes every effort to ensure that the product information displayed on our website is accurate. The descriptions, dimensions and images contained herein are a guide only and in all cases may be subject to change at any time. The Company makes no representation or warranty, either express or implied, as to the accuracy or completeness of the descriptions given.

Delivery

The Company uses the services of a third party Carrier to collect, transport and deliver Goods. The Company shall not be liable for any failure of service on behalf of the Carrier. The Company does not guarantee or underwrite the guarantees of any Carrier. Delivery is to ground floor front door only unless otherwise stated.

We are unable to deliver our products overseas. This includes adresses in Channel Islands, Isle of Wight, Isle of Man, Scilly Isles, Scottish Highlands, Scottish Islands & Northern Ireland.

Customers residing North of Aberdeen (or Scottish Highland Postcode Areas) should contact us for a delivery quote prior to ordering.

Naturally, your purchase should arrive in perfect condition however, on delivery the Buyer must inspect all boxes carefully for any transit damage and mark the delivery document clearly "DAMAGED" if there is any. Goods in transit are fully insured, however this insurance is immediately voided if the document is marked anything other than "DAMAGED". Under NO circumstances should the delivery document be marked "UNCHECKED" or anything similar. These instructions are particularly important if someone is receiving the items on your behalf. Buyers may NOT subsequently claim their item was damaged in transit when the delivery note has been signed as "Received in Good Order".

Faulty or Missing Components

It is our policy to replace faulty or missing components quickly and efficiently. On receipt of your Goods, carefully unpack and check that all components are present and in good order. Should you find that any component is missing or faulty, the Buyer must notify the Company in writing, providing photographic proof of the faulty components within 48hours of delivery. Electronic communication IS acceptable. The Buyer may NOT claim for free replacements of faulty or missing components after this time. The use of non OEM components or parts not directly supplied by the manufacturer, importer or distributor invalidates all guarantees and warranties.

Returns

Inline with Distance Selling Regulations, Buyers may return items within 14 days of receipt for a refund less carriage charges. Where carriage has been provided as 'free', the true cost of carriage will be deducted from any refund. Items must be returned unused and in their original packaging. Assembled items, partly assembled items, mattresses, special order & custom made items may not be returned under any circumstances. The Buyer is responsible for returning items, their transportation and obtaining adequate insurance for  the journey. A 20% re-stocking fee is payable on all returns. All items currently displayed on ShortyBeds website are ' custom made / made to order ' and may not be returned. Faulty items, components etc will be replaced at our discretion.

Guarantee

All products are supplied with the manufacturers standard warranties . Guarantees vary by product. If in any doubt as to the limitations of the warranty of your product, be sure to enquire prior to purchasing.

As a general guide...

Solid wood ( pine, oak etc ) and metal products are guaranteed for 12 months.

Upholstered products such as sofa beds, leather beds, other fabric covered products ( including faux leather ) and headboards are guaranteed for an absolute maximum of 12 months.
Foam products such as mattresses, pillows and toppers are guaranteed for a minimum of one year.
Sprung mattress are guaranteed for 12 months with the exception of budget range, classic quilted and children's mattresses which are guaranteed for an absolute maximum of 6 months. This guarantee is limited to the integrity of the spring unit  & fillings.The warranty does not apply to the covering fabric.

Products are NOT guaranteed against accidental damage, misuse ( including but not limited to jumping and / or horseplay), poor assembly and / or wear and tear leading to loss of support in upholstered products and mattresses.

Postage and Packing ( P&P ) charges apply to all items replaced under guarantee unless they are collected from our warehouse.

All prices displayed on our website include VAT at the current rate of 20%
